Blistex Corporation (“Blistex,” “we,” “us,” and “our”) understands that privacy is important to you as the user of our products (“you” and “your”). This privacy policy (“Policy”) applies to the information we collect from or about you through our Site, https://www.glysomed.ca (the “Site”), which is owned and operated by Blistex Corporation, and the uses we make of such information. This Policy does not apply to any information collected by any third party Site or any information collected by Blistex offline.

Personal information is any information about you that allows you to be directly or indirectly identified (for example, by combining it with other information).

By providing us with your personal information after you have been informed of this Policy, in accordance with applicable laws, you consent to the collection, use, storage and communication of such information as set out in this Policy. In certain cases, your consent may also be implicit, in accordance with your reasonable expectations.

This Policy may be amended from time to time and we may also provide additional privacy notices (“Privacy Notices”), and any modifications will enter into force on the date specified in the update. Please regularly check for changes to this Policy and for Privacy Notices. In some cases, specific Privacy Notices may be required to comply with the privacy laws of one of the countries, provinces, or states in which we do business.

What Information We Collect

We collect your personal information on our own behalf and on behalf of Blistex Inc. and our affiliates.

We will collect your information only when we have your consent, which may be express or implied in certain circumstances, or as otherwise permitted or required under applicable laws.

The personal information which we collect could include your name, address, telephone number and e-mail address. The type of personal information we collect depends on various factors and on the context. We only collect such personal information that we consider necessary for the conduct of our business and the fulfilment of identified purposes.

We may also collect personal information from our business partners or other third parties, provided that such third parties confirm that you have authorized them to disclose such information to us or that you expressly consent to such disclosure.

How We Use Your Information

We collect personal information through the Site for the following purposes:

  • to provide the information, products and services you request;
  • to provide you with effective customer service;
  • to provide you with a personalized experience when you use the Site;
  • to contact you with information and notices related to your use of the products and Site, in accordance with anti-spam legislation and with your express consent as required;
  • to improve the content, functionality and usability of the Site, if permitted by, and in accordance with, applicable law;
  • to better understand your needs and interests;
  • to improve our products;
  • to improve our marketing and promotional efforts, in accordance with anti-spam legislation and with your express consent as required;
  • for security, credit or fraud prevention purposes;
  • for the collection of information for the documentation and recordation of potential adverse health events; and
  • for compliance with regulatory obligations, including but not limited to Health Canada requirements.

In addition to the purposes described above, we will inform you of other purposes for which your personal information is collected when it is collected. If we intend to use the personal information we have collected for purposes not previously communicated, we will ask for your separate consent before doing so, unless applicable laws allow us to do so without your consent. The personal information collected will be stored for up to 25 years or otherwise in accordance with applicable laws and regulatory obligations.

How We Share Your Information

Except as otherwise set out in this Policy, your personal information is disclosed only to our authorized employees who have a business need to access it, for example: our customer service centre and personnel responsible for providing products and services to our customers. These employees can only access the personal information they require to perform their job functions.

We will only disclose to third parties personal information about you (the type of personal information disclosed is situation-dependent) in the following situations:

  • For an Authorized Purpose: For a specific purpose for which you have authorized us to disclose the information to a third party.
  • With Third-Party Vendors: Blistex shares information collected through the Site with its customer service team, quality assurance personnel, and third-party vendors (“Service Providers”) who act for us or on our behalf. Services Providers include manufacturing providers, information technology service providers, data hosting providers, logistics service providers, quality assurance service providers, regulatory affairs service providers,  and marketing solution providers. For example, we may use Service Providers to design and operate the Site, or to develop software applications and databases; to conduct surveys; and to help us with our promotional efforts. These Service Providers may need may have access to your personal information in order to perform these functions on our behalf. The personal information is disclosed to such Service Providers only in the context of their provision of services, it being understood that Service Providers must respect strict contractual terms that oblige them to maintain the privacy of all information, to use the personal information only for the purposes of providing the services and to not keep the information after the expiry of their agreement with us. If permitted by and in accordance with applicable law, these Service Providers may also contact you or send communications on our behalf, including, without limitation, in connection with market research studies about our products or our competitors’ products.
  • With Our Affiliates: Blistex may share the information collected through the Site with our affiliates, including our subsidiaries and parent company (collectively “Other Parties”). Our Other Parties may use the information for the purposes listed in this Policy, provided that such use is in accordance with this Policy.
  • As Part of a Business Transfer: Your information may be transferred to a successor organization if, for example, we transfer the ownership or operation of the Site to another organization or if we merge with another organization. If such a transfer occurs, the successor organization’s use of your information will still be subject to this Policy and the privacy preferences you have expressed to us.
  • To Comply with Laws and Protect Our Rights and the Rights of Others: We may disclose your information when we, in good faith, believe disclosure is appropriate to comply with the law, a court order or a subpoena. We may also disclose your information to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of the Site; to enforce or apply our Terms of Use or other agreements; or to protect our own rights or property or the rights, property or safety of our users or others. We also reserve the right to disclose your information as described in any click-through agreement to which you have agreed.
  • As otherwise required or permitted by applicable laws.

What Are The Roles And Responsibilities Of Personnel With Access To Personal Information?

We have informed our employees of their obligation to preserve the privacy of personal information, and we continue to raise awareness about its importance. Our employees can only use personal information pursuant to the terms of this Policy and our other policies. We have set out the roles and responsibilities of our personnel throughout the cycle of handling your personal information, from collection to destruction, in a personal information governance and management policy.

How We Collect Your Information

Information You Manually Provide
Blistex collects the information you manually provide (using your keyboard, mouse, or touchpad on your computer, mobile or tablet device (collectively, “Device”)) when you use the Site. For example, we collect the information you provide via e-mail and feedback/comment forms. In certain sections of the Site (e.g., “Contact Us”), we request and collect personal information that may be used to contact you directly to respond to questions, comments or inquiries you submit, or to contact you about a contest or sweepstakes you enter on the Site.

Information From Your Mobile or Tablet Device
If you access the Site through your Device, we may automatically collect certain information from or about your Device using analytical tools or digital markers on our Site. The types of information we may collect include the type of Device you use, the IP address of your Device, your Device’s operating system, the type of Internet browsers you use, and information about the way you use our Site. Some of this information may not be, in and of itself, personally identifiable, but we may combine it with other information in an attempt to identify you or we may combine it with information that does identify you.

Information Collected by Cookies and Similar Technologies
We use technologies to collect information and support certain features of the Site, such as cookies or other tracking technologies. For example, we may use these technologies to:

  • collect information about the ways visitors use the Site – which pages they visit, which links they use, and how long they stay on each page;

In addition to the cookies we may deliver to your Computer or Mobile or Tablet Device through our Site, certain third parties may deliver cookies to you for a variety of reasons. Please note that the Add-on does not prevent information from being sent to us.

In addition, you may opt-out of having interest-based information collected by certain entities during your visits to our Site or other websites. You will be directed to an industry-developed website that contains mechanisms for choosing whether each listed entity may collect and use data for online behavioral advertising purposes. It may be that some of the third parties that collect interest-based information on our Site do not participate in the industry-developed opt-out website, in which case the best way to avoid third-party tracking of your online behaviors may be through your browser settings and deletion of cookies.

Our Site may link to third-party websites or advertisers. These third-party websites or advertisers may collect certain personal and non-personal information, including, product usage data, and general location based information. Please note that this Policy applies only to the personal information that we collect or receive from third parties with your consent and we cannot be responsible for personal information that third parties may collect, disclose, store and use, including through their websites. These third-party sites or advertisers may share information they collect about you with us provided that such third parties confirm that you have authorized them to disclose such information to us or that you expressly consent to such disclosure. How We Protect Your Information

Blistex takes reasonable physical, technical and administrative precautions to provide a level of security appropriate to the sensitivity of the information we collect. Although we use reasonable measures to help protect your information against unauthorized use or disclosure, due to the inherent open nature of the Internet, we cannot ensure or warrant the security of any information provided online. The security  measures we take include technical measures, such as firewalls, and administrative measures, such as adopting an information security policy.

Is It Possible To Refuse The Collection Of Personal Information?

You can refuse to consent to the collection of your personal information. However, doing so could limit our ability to offer you services or products. If you withhold such consent, we will not deny you products or services unless they cannot be provided without such collection.

Disclaimers

We cannot guarantee the security of information provided over the Internet or stored in our databases and will not be responsible for breaches of security beyond our reasonable control.

While Blistex has safeguards in place to prevent unauthorized access or interception, there is no absolute guarantee of security. In the event of an interception or unauthorized access, Blistex shall not be responsible for such interception or unauthorized access, or any direct, indirect, special, incidental, or consequential damages (including lost profits) suffered by you, even if Blistex has previously been advised of the possibility of such damages. Blistex does not warrant, either expressly or implied, that the information provided by you shall be free from interception or unauthorized access and does not provide any implied warranties of merchantability and fitness for a particular purpose.

Blistex will make every effort to accommodate reasonable requests for information pertaining to our Site, products and services in a timely manner but makes no guarantees for the timeliness of such responses. You should be aware that Blistex is not responsible for delay, non-delivery or non-receipt of any information exchanged between Blistex and the user or vice-versa due to internet connectivity problems, man-made or natural disasters, force majeure, computer malfunctions or incorrect contact information (including but not limited to e-mail addresses, mailing addresses, telephone, cellular, pager or fax numbers) you supply.

Retention of Personal Information

Blistex retains the personal information collected on the Site as long as required for the fulfilment of the identified purposes, as long as it is reasonable to do so for customer service, legal or commercial reasons. The retention period depends on the purposes and the nature of the information. On the expiry of this period, we permanently and securely destroy or anonymize the information in compliance with applicable laws.

Child Privacy

It is our intention to comply with all applicable laws regarding children’s privacy and advertisements that target them. We do not seek to collect personal information about minors under 14 years of age without the verified consent of the person having parental authority. We do not knowingly collect personal information from children under 14 without parental consent or allow children to become subscribers, make submissions, register with us, order our products or services, communicate with us, or use any of our online services. Where Do We Store Personal Information And Do We Communicate Personal Information Outside Of the Province of Québec?

Depending on the nature of the personal information, it may be stored in our offices, as well as in the various computer systems in our offices, in our storage facilities, or in those of our service providers.

Your personal information may be communicated outside of the province of Québec or Canada, for the purposes described above, including its collection, use, disclosure and storage, and if so communicated such personal information will be treated in accordance with the laws of the jurisdiction to which it is communicated.

Your Privacy Rights And How To Exercise Them

Subject to the limits and provisions of applicable laws, you have the right to:

  • Consult your personal information;
  • Rectify or update your personal information;
  • Withdraw your consent at any time (the withdrawal of consent is binding for us with regard to the personal information the use of which was based on such consent; the withdrawal of consent will not affect the lawfulness of use based on your consent before its withdrawal);
  • Request the deletion of your personal information if it is outdated or not justified for the purposes it was collected.

If you submit a request to withdraw your consent to use, communicate and store your personal information, how we handle that request will depend on the situation and reasons. Depending on the situation:

  • You may withdraw your consent, but we will no longer be able to provide you a service or product that requires such consent;
  • You may not withdraw your consent because processing your personal information is necessary or mandatory.

In either case, we may be legally required to retain certain personal information.

You may exercise the foregoing rights at any time by contacting our Privacy Officer (see below).

Any such request must contain sufficient details for us to be able to address it. We undertake to respond to any such request within a reasonable period of time, and to the extent possible and where required by applicable law, within a maximum of thirty (30) days. We must, however, first verify the identity of the person making such a request. We will make commercially reasonable efforts to comply with requests to alter your personal information to cause it to be as accurate, complete and up-to-date as possible for the purposes for which it is used. However, it is your responsibility to advise us of changes to your personal information, such as your contact information.

What Is Our Complaint Process Regarding The Protection Of Personal Information?

You may file a complaint with our Privacy Officer (see below) if you believe that we are not complying with our obligations to protect personal information. We will confirm receipt of your complaint, contact you for more information as needed, conduct a confidential investigation and share its conclusions with you. If your complaint is justified, we will take appropriate measures to correct the situation. If you are unsatisfied with our internal review of your complaint, you can contact the following organizations responsible for the protection of personal information: the Office of the Privacy Commissioner of Canada (federal), Québec’s Commission d’accès à l’information, the Office of the Information and Privacy Commissioner for British Columbia or the Office of the Information and Privacy Commissioner of Alberta.

Changes To Our Privacy Policy

We reserve the right, at our discretion, to add to, change, update, modify or remove portions of this Policy at any time. Any changes we make will become effective when on the date specified in the update. We encourage you to periodically review the Site for the latest information on our privacy practices. You are bound by any changes to the Policy when you use the Site after such changes have been first posted.
